Formal Debt Collection

Sometimes, despite the efforts of the credit controllers, payment just doesn’t materialise and further action is required. Unfortunately, the customer’s behaviour leaves you with no other option. Whether the resolution is Mediation, Debt Recovery & Court Action, we’ll deal with that. Uncomfortable conversations can be a thing of the past. Any cases requiring formal debt collection will be passed over to our sister company, Gordon & Noble Sheriff Officers. Collecting what’s due for Commercial and Consumer clients is what they do. They provide a fast-paced service to collect your debts either by letter, phone or field visits. Our involvement with the case during the credit control process allows us to inform Gordon & Noble of the prior history of any matter, allowing them to quickly implement the most effective and economical course of action to recover money owed to you. Gordon and Noble will not only seek to recover the debt, but they will also pursue for any fees due under your company terms & conditions and statutory late payment interest and compensation.

Litigation / Court Action

This is unavoidable under certain circumstances. Every effort is made to reach a positive outcome without the need for court action, however, when called upon we will work closely with some of the most experienced solicitors throughout the UK to provide a streamlined process for raising court actions. We are your start to finish solution in recovering outstanding debt. Working with partner solicitors, we manage the whole litigation process on your behalf. We will always act in your best interests ensuring each case is treated individually and that your professional reputation and ours is never compromised. The Litigation team is focused on ensuring a satisfactory resolution of every account they handle. Our dedication to customer service and integrity, combined with our outstanding legal knowledge and experience, have led to the successful payment of numerous and difficult debts. We’ll ensure you know exactly what to expect from every stage of the process, including what fees may be incurred.

Enforcement

If Enforcement is required, then based upon information already gathered, Gordon & Noble will identify and action the most effective and efficient means of enforcement to ensure the quickest and most cost-effective means of recovery. These can include, but are not limited to, seizing articles to be sold at auction, freezing bank accounts, arresting earnings, and preventing sales of property until debts are paid. Should the debtor reside out with Scotland, then we will liaise with our enforcement partners throughout the UK and abroad. Have you or your clients obtained a Decree or County Court Judgement, but have been unsuccessful in recovering the money? Gordon & Noble provide a specialist service to assist with recovery of ‘hard to collect’ debts. We will provide a review and consultation of each case free of charge. As part of the review, we will conduct enquiries to gather any information which could assist with recovery. We are conscious that you will not want to throw ‘good money after bad’ and we will only make enforcement recommendations where there is a reasonable prospect of success.
